Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Afterplots website and hosted application (together, the "Service") provided by Afterplots ("we," "us," or "our"). By creating an account, clicking to accept, or using the Service, you agree to these Terms and our Privacy Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes both you and the organization.

1. The Service

Afterplots provides software tools to help local businesses work listing and neighborhood signals, score prospects, generate creative assets, operate tokenized landing pages, configure integrations, and—where enabled—coordinate print or mail workflows through integrated partners. Features vary by plan and configuration.

We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable. We do not guarantee uninterrupted availability or error-free operation.

2. Accounts, teams, and security

  • You must provide accurate registration information and keep it current.
  • You are responsible for activity under your account and for safeguarding credentials.
  • Workspace roles (such as admin, full, or viewer) control what users can change. The workspace owner and admins are responsible for invitations and permissions.

3. Acceptable use

You agree not to:

  • Use the Service in violation of law or third-party rights;
  • Send unlawful, fraudulent, defamatory, harassing, or discriminatory communications;
  • Attempt to gain unauthorized access to the Service, other accounts, or underlying systems;
  • Reverse engineer the Service except where applicable law prohibits this restriction;
  • Use the Service to build a competing product by systematic scraping or extraction of our non-public interfaces;
  • Overload or disrupt the Service (for example by abusive automation).

4. Marketing, mail, and compliance

You are solely responsible for compliance with laws and regulations that apply to your outreach, including without limitation telemarketing, email, SMS, direct mail, and advertising rules (such as TCPA, CAN-SPAM, state analogues, and industry-specific requirements where they apply to you). You are responsible for consent, suppression lists, truthful claims, and honoring opt-outs.

Property, permit, and enrichment data shown in the Service may be incomplete, stale, or sourced from third parties. You must verify material facts before relying on them for compliance-sensitive decisions. Afterplots does not provide legal, tax, appraisal, or permit advice.

5. Your content and license to us

You retain ownership of content you submit ("Customer Content"). You grant Afterplots a non-exclusive, worldwide license to host, process, transmit, display, and create derivative outputs (such as generated creative) as reasonably necessary to provide and improve the Service and to operate integrations you enable.

You represent that you have the rights needed to submit Customer Content and that your use does not violate third-party rights. We may remove or restrict content that violates these Terms or creates risk, where we reasonably deem necessary.

6. AI-assisted outputs

Some features use machine learning models to draft text, images, or scores. Outputs may be inaccurate or unsuitable for a particular use. You are responsible for human review before publication, mail, or paid media. Do not rely on model outputs as statements of fact about people, properties, or legal status without verification.

7. Third-party services

The Service may interoperate with third-party platforms (for example payment processors, maps providers, model providers, webhooks you configure, and print partners). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services you choose to use.

8. Fees, trials, and taxes

  • Paid plans, credits, and add-ons are billed as described at checkout or in-product.
  • Payments are processed by our designated payment processor (currently Stripe). Subscriptions renew until canceled according to the processor's flows and your plan settings.
  • Fees are exclusive of taxes unless stated otherwise; you are responsible for applicable taxes.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, or if we discontinue the Service in accordance with law. Provisions that by their nature should survive (including disclaimers, limitations, indemnities, and governing law) survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT LISTING, PERMIT, OR PROPERTY DATA IS ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AFTERPLOTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO AFTERPLOTS FOR THE SERVICE DURING THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (US $100) IF YOU HAD NO FEES DURING THAT PERIOD.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

12. Indemnity

You will defend and indemnify Afterplots and its affiliates, officers, directors, employees, and agents against any third-party claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your Customer Content, your outreach or advertising, your violation of law, or your breach of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Subject to applicable law, exclusive jurisdiction for disputes will be the state and federal courts located in Delaware, and you consent to personal jurisdiction there.

If you are a consumer in a jurisdiction that gives you mandatory rights, nothing in this section limits those rights where prohibited.

14. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior understandings on the subject.
  • Assignment. You may not assign these Terms without our consent. We may assign in connection with a merger, acquisition, or sale of assets.
  • No waiver. Failure to enforce a provision is not a waiver.
  • Severability. If a provision is invalid, the remainder remains in effect.
